Welcome to StandbyProof, a service of Casting Karma LLC ("StandbyProof," "we," "us"). StandbyProof helps facilities schedule, log, and document the inspection and testing of emergency and standby power systems. By creating an account or using the service you agree to these terms. Please read them — Section 12 requires disputes to be resolved by binding arbitration and waives class actions.

1. What StandbyProof is — and what it is not

StandbyProof helps you (a) build a testing and inspection schedule from a rule set reflecting NFPA 110 and related CMS/Life-Safety-Code requirements, (b) log the tests and inspections you perform in the field, and (c) generate a documentation packet you can present to demonstrate your recordkeeping.

StandbyProof is a recordkeeping and reminder tool. It does not inspect, test, certify, approve, or guarantee anything. Specifically, StandbyProof is not:

You remain solely responsible for performing the actual inspections and tests, for the condition and operation of your equipment, and for determining and meeting the requirements that apply to your facility. We document what you enter; we do not verify it, and we never warrant that your records — or your facility — will pass any survey, inspection, or accreditation, or achieve any particular outcome.

No reliance; assumption of risk. StandbyProof is a recordkeeping, scheduling, and reminder aid — not a guarantee of compliance and not a substitute for your facility's own compliance program, qualified personnel, or professional judgment. The schedule, the reminders, and the documentation packet are tools to help you do the work; they do not perform, verify, or guarantee the work, and they do not ensure that you will pass any survey, inspection, or accreditation. You are the sole party responsible for your emergency and standby power systems and for meeting every requirement that applies to your facility, and you assume all risk arising from your use of, or reliance on, the Service, the schedule, any reminder, or any generated record or packet.

2. No patient information (PHI) — read this before you upload anything

StandbyProof is a facilities and equipment tool. It is not designed for, and must not be used to store, patient information. You agree not to enter, upload, or transmit any Protected Health Information (PHI) or any individually identifiable patient or resident health information — including in photos, notes, or file uploads.

We do not act as a HIPAA "business associate" for you, no Business Associate Agreement (BAA) is in place or implied, and StandbyProof should not be used in any workflow that requires one. If you input PHI in violation of this Section, you do so at your own risk and are responsible for the consequences, and we may remove it.

3. Your account and authority

You must be at least 18 years old, provide accurate information, and keep your login secure. You're responsible for activity under your account. If you use StandbyProof for a facility or organization, you represent that you are authorized to bind it to these terms.

4. The rule set and schedule — accuracy and your responsibility

The testing/inspection schedule StandbyProof produces is generated from a rule set that reflects our good-faith reading of NFPA 110 and applicable CMS/Life-Safety-Code requirements, pinned to a stated code edition. Codes are revised, adoption dates differ by jurisdiction, and accreditors impose their own requirements. The rule set may be incomplete, may lag a change, or may not reflect a local amendment or an interpretation your AHJ or accreditor applies. It is not legal or engineering advice. You are responsible for confirming the requirements that actually apply to your facility with your AHJ, accreditor, and qualified professionals. Each requirement in the app is stamped with its source citation and the code edition it reflects, so you can verify it. Test intervals, tolerance windows, and which tests apply can vary by code edition, jurisdiction, accreditor, and equipment, and any interval shown in StandbyProof may be incorrect or inapplicable to your facility. You must independently verify each interval and requirement against the governing code and your AHJ, and you — not StandbyProof — are solely responsible for performing every required test on time. StandbyProof does not warrant that its schedule is correct, complete, or sufficient for compliance, and is not liable for any missed, late, or skipped test or inspection or any resulting citation, deficiency, or survey outcome.

5. Reminders and notifications — a convenience, never a guarantee

StandbyProof can send email reminders to help you keep your testing on schedule. Reminders are an optional convenience only. They are not a monitoring or watch service, and they are not a substitute for your own tracking and performance of every required test and inspection.

We do not guarantee, and expressly disclaim any warranty, that any reminder will be generated, accurate, complete, timely, delivered, or received. Reminders depend on third parties — our email provider, your mail servers, and spam filters — and on the accuracy of the schedule and the data you enter, all of which are outside our sole control. A reminder may not be sent, may be delayed, may be filtered or lost, or may never reach or be seen by you.

We have no duty to monitor your compliance and no duty to remind you of any test or deadline. THE ABSENCE OF A REMINDER IS NOT, AND MUST NOT BE RELIED ON AS, AN INDICATION THAT NO TEST OR INSPECTION IS DUE, OR THAT YOUR FACILITY IS COMPLIANT. You remain solely responsible for knowing, scheduling, performing, and logging every required test and inspection on time, whether or not any reminder is sent, received, or seen. You assume all risk arising from the reminder feature, including any failed, delayed, missed, or undelivered reminder, and any resulting loss is subject to Sections 9 and 10. Enabling or disabling reminders does not change these responsibilities. We may add, change, suspend, or discontinue reminders at any time.

5A. Sealing, verification & attestation — what “sealed,” “verified,” and “attested” mean

When you save a test log or issue a compliance packet, StandbyProof “seals” it by recording a cryptographic hash of its contents, chaining that hash to prior records, obtaining an independent RFC-3161 timestamp from a third-party time-stamp authority, and signing it with StandbyProof’s key. Anyone can “verify” a sealed record without an account. A successful verification proves only three things: (a) the record’s content has not changed since it was sealed (it is tamper-evident — a later change is detectable, not impossible); (b) the record existed and was sealed no later than the independent timestamp (its seal time cannot be backdated by us); and (c) the record was issued by StandbyProof. Verification does NOT prove, certify, or represent that any test or inspection was actually performed, was performed correctly or adequately, occurred on any particular date, or satisfies any code, standard, or requirement. The seal proves when a record was sealed, which may differ from when a physical test was performed; both dates are shown where recorded. StandbyProof is not the Authority Having Jurisdiction and does not certify code compliance. (See Sections 1, 4, and 9.)

“Attested” means a person’s statement, not ours. When a test is logged, the signed-in StandbyProof user electronically attests to it — a named confirmation, bound to their authenticated account, that the test was performed and the results are accurate. That attestation is that person’s statement, not StandbyProof’s; StandbyProof records who performed the test and who attested to it, but does not independently confirm, certify, or verify that the underlying test occurred or was performed correctly. Where a generated packet includes a handwritten signature line, that signature is optional — some Authorities Having Jurisdiction or accreditors may prefer or require one, and you are responsible for confirming your AHJ’s or accreditor’s preference.

6. Acceptable use

Don't misuse the service: no unlawful or infringing use; no attempts to break, overload, scrape, or reverse-engineer the platform; no reselling or redistributing the rule set or the service; and no PHI (Section 2).

7. Plans, billing & subscription

StandbyProof is a paid subscription, priced by generator/equipment coverage as shown at checkout, billed monthly or annually as selected (annual is charged up front and includes two months free). Subscriptions renew automatically until cancelled; you may cancel anytime and cancellation takes effect at the end of the current paid period. Except where required by law, fees are non-refundable and partial periods are not prorated. You authorize us and our payment processor to charge your payment method for all fees and applicable taxes. We may change pricing or features on prospective notice, effective at your next renewal. If a payment fails, access may be suspended, but your logs and records are retained and remain exportable — we do not delete your compliance history because a payment lapsed.

7A. Free trials

If your subscription includes a free trial, this section applies. We collect and validate a payment method when you sign up; you are not charged during the trial. Unless you cancel before the trial ends, your subscription automatically converts to a paid subscription at the end of the trial: your payment method is charged the then-current fee for the plan you selected, on the interval you selected (monthly or annually), and renews automatically thereafter under Section 7. We send a reminder to the email on your account before the trial converts. You may cancel at any time during the trial at no charge — from your account or the link in our emails — and cancellation takes effect at the end of the trial, with access continuing until then. The trial length, plan, and price are shown at signup and in your trial-confirmation email. We may offer, change, condition, limit (including to one per customer or account), or discontinue trials at our discretion. Except where required by law, fees charged after a trial converts are non-refundable.

8. Your content

The facility, equipment, test-log, and document data you enter is yours. You grant us the limited rights needed to host, process, and display it to operate the service for you and to generate your reminders and documentation packet. You can export your records and delete your account at any time.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE, THE RULE SET, ANY REMINDER, OR ANY GENERATED PACKET IS ACCURATE, COMPLETE, CURRENT, OR SUFFICIENT FOR ANY SURVEY, INSPECTION, ACCREDITATION, OR REGULATORY PURPOSE. STANDBYPROOF IS NOT A SUBSTITUTE FOR ACTUAL INSPECTION AND TESTING OF YOUR EMERGENCY POWER SYSTEMS BY QUALIFIED PERSONNEL, OR FOR THE JUDGMENT OF YOUR AHJ, ACCREDITOR, AND PROFESSIONAL ADVISORS. Decisions about your facility's life-safety systems are yours.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASTING KARMA LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR REVENUES, OR FOR ANY SURVEY CITATION, DEFICIENCY, FINE, LOSS OF ACCREDITATION OR CERTIFICATION, EQUIPMENT OR GENERATOR FAILURE, POWER LOSS, PROPERTY DAMAGE, INJURY, OR DEATH; OR FOR ANY FAILED, DELAYED, MISSED, INACCURATE, OR UNDELIVERED REMINDER OR NOTIFICATION; ANY MISSED TEST, INSPECTION, OR DEADLINE; ANY ERROR, INTERRUPTION, DOWNTIME, DATA LOSS, OR FAILURE OF THE SERVICE OR OF ANY EMAIL OR TRANSMISSION; OR ANY INCOMPLETENESS OR INACCURACY IN THE RULE SET, SCHEDULE, OR ANY GENERATED PACKET — WHETHER OR NOT INFORMED BY, OR RESULTING FROM ANY ACT OR OMISSION OF, THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limits apply regardless of the theory of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations; there, our liability is limited to the maximum extent permitted.

11. Indemnification

You will defend, indemnify, and hold harmless Casting Karma LLC and its owners, members, employees, and contractors from any third-party claim, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of or related to: your use of the service; your inspection, testing, maintenance, and compliance decisions; any PHI you input in violation of Section 2; your content; or your breach of these terms or of any law.

12. Governing law; dispute resolution

These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. The parties will resolve any dispute arising out of or relating to the service or these terms by final, binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Texas, before one arbitrator; judgment on the award may be entered in any court of competent jurisdiction. Each party waives any right to participate in a class, collective, or representative action. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual property or confidential information. Any claim must be brought within one (1) year after it accrues, to the extent permitted by law.

13. Changes & termination

We may update the service and these terms. Material changes will be posted here with a new version and effective date and, for active subscribers, communicated by email or in-app notice, and we'll ask you to accept them at next sign-in. You may stop using StandbyProof at any time. We may suspend or terminate accounts that violate these terms, and may suspend paid features for non-payment as described in Section 7.
